do you know 40 steps

You can not go from the steps to the water accidentally- you have to walk around the wall at base of the steps. Hello. You have to step on the rocks. You don't get there accidentally. UGHHHHHHHHHHHHHHHHHHHH. That's the point.

The sentence states that she fell from the stairs to the rocks. You don't just fall to the rocks from the stairs. duh.

algae

People fall there all the time. It's covered in green algae, but people don't know how slippery it is. A good question would be why she didn't just swim back to the rocks where she fell off and find a part that's not slippery.

Do I smell lawsuit?

She will definitely sue the city, especially after they caved in and settled and payed out to the guy who fell of the rocks a few years back. The State told him to take a hike and he got nothing from them, so now when anybody falls off of the cliff they will sue the city.
